GOOD THINGS FESTIVAL TERMS AND CONDITIONS

A. EVENT TERMS AND CONDITIONS OF PURCHASE AND ENTRY

These conditions are to be read in conjunction with the Merchant Terms and Conditions of Sale for Tickets as below. Good Things Festival is presented by There is a Free Lunch Pty Ltd (ACN 628 092 964) trading as Good Things Festival care of P.O. Box 6191 Fairfield Gardens QLD 4103 ("Us, Our, We, the Presenter").

By purchasing this ticket, You acknowledge and agree;

1. All conditions shown on this ticket are to be read together with all other statements or directives either shown on this ticket or displayed on Our website or at the event premises.

2. By entering the event, You, the attendee, acknowledge and agree that You have read the following rules governing conduct and consent to abide by such regulations and conditions.

3. Before attending the event, You agree to download the State Government Services App OR QR Code Check-in App for the relevant state and to use the App to check in on entry.

4. Any patrons who presents with COVID like symptoms will be refused entry to the event and escorted directly to the medical booth.

5. There are STRICTLY NO PASS OUTS (Exit and Re-entry) for this event.

6. Good Things Festival (GTF) is a licensed event recommended for a mature audience. Sydney Good Things is an over 18 only event.

7. Photo ID is required to purchase alcohol regardless of Your age. It is illegal to provide minors with alcohol and anyone caught doing so may be prosecuted and ejected.

10. It is a condition of sale that You agree that the Presenter reserves the right to refuse a ticket holder admission to the event or to evict that person from the event for any reason whatsoever at the Presenter’s absolute discretion.

11. It is a condition of the liquor license that only valid ticket holders are allowed to enter the event and You may be prosecuted if You enter or attempt to enter without a valid ticket.

Age Restrictions

12. We advise the event has the capacity to be very loud, have high intensity crowd movements, bands that may use profanities in their performance and patrons drinking alcohol

13. No minors can be admitted including babes in arms.

14. We strongly advise and recommend that the show is unsuitable for any child under the age of 15.

15. BRISBANE / MELBOURNE ONLY: Good Things Festival (GTF) is a licensed all ages 15+ event recommended for a mature audience.

16. SYDNEY ONLY; Good Things Festival (GTF) is a licensed OVER 18+ event.

17. All patrons agree to be wrist-banded on entry. Two easily distinguishable wristband types are to be applied to patrons on entry; one for 18+ and one for Youth ticket holders, if applicable.

18. All adult patrons entering the site must provide photo ID to secure an 18+ wristband, to allow You to purchase alcohol. All persons unable to provide ID will be provided with an underage wristband.

19. All Youth ticket holders attending the event must be accompanied by a parent, guardian or responsible adult and each person attending must have their own valid ticket.

20. Youth ticket holders without a parent, guardian or responsible adult will be refused entry to the event.

21. At time of purchase additional compulsory emergency contact name and mobile number fields are applied to the sale of a Youth ticket, these details will be applied to each individual Minor U18 wristband. Youth patrons can collect this wristband at the entrance on the day.

Accessibility

All venues have wheelchair access and disabled amenities, please visit the event website for accessibility and carer info.

Tickets

23. Your tickets should be treated as cash. Except as required by law, tickets will not be replaced nor money refunded after purchase. The Presenter does not offer refund in the event of lost, stolen or damaged tickets or where the ticket holder cannot attend the event due to reasons beyond the Presenters control.

24. In the event of a lost ticket, contact info@oztix.com.au prior to the event. Your receipt or print out of the terms and conditions are not tickets and are not valid for entry to the event

25. Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser or any subsequent ticket holder. If a ticket is sold or used in breach of this condition, the Presenter reserves the right to refuse entry and may cancel the ticket without a refund.

26. This ticket is only valid when purchased from official agents.

27. Tickets bought from non-official websites or other sources may be refused entry.

28. There is a sale limit of 8 tickets per person to any of the events. Online Tickets will be available until sold out or until nominated by the presenter.

29. Minor tickets can only be purchased in a bundle with an adult 18+ ticket.

Behaviour & Operations

31. Except in circumstances beyond our control, we play rain or shine.

32. Crowd surfing, moshing, slam or circle dancing are all dangerous activities that can lead to serious injuries to other patrons and will not be tolerated.

33. Please note there are restricted capacities at some stages and other tented structures. Once the maximum capacity is reached in these areas there may be no further admissions. Your purchase of an event ticket does not guarantee admission to these areas in such cases.

34. In some states smoking in a public place is not permitted. It can be an offence to smoke in a public place and You risk being fined. If Your State has this law We will provide a designated outdoor smoking area and We require You to use them.

35. Except as provided by law, the Presenter and the owner and/or lessee of the venue shall not be held liable for any loss, injury or damages sustained entering or within the venue whether caused by the negligence of the Presenter or that owner or lessee or otherwise.

36. Ticket holders consent to filming and sound recording as members of the audience.

37. No pass outs will be issued unless otherwise advised.

38. In the case of an emergency evacuation or situation, please follow all official directives from police security or event organisers.

39. If You feel at any time that You or anyone else's health or safety is threatened, You should contact the nearest security guard. There are First Aid and Lost Minor Officers on site at all times who can be contacted by security staff.

40. All Youth ticket holders attending the event must be accompanied by a parent, guardian or responsible adult at all times.

41. If a minor is to become separated from their parent, guardian or responsible adult within the site, RSA crowd controllers will escort the minors to the Lost Minors tent. Event staff will notify the parent, guardian or responsible adult to collect the minor.

42. Any minor caught consuming alcohol will be handed to the Police.

B. TICKET TERMS AND CONDITIONS OF SALE

These Ticket Terms and Conditions of Sale to be read in conjunction with the Presenters Event Terms and Conditions above.

Who You are buying from:

A. This website is owned and operated by There Is A Free Lunch Pty Ltd (ACN 628 092 964) trading as Good Things Festival care of PO Box 6191 Fairfield Gardens QLD 4103 ( 'We', 'Our' or 'Us'). We sell tickets offered via this website as follows;

B. We sell tickets offered via this website as the event organisers ('Presenter') and any tickets purchased from this website are purchased from Us as the Presenter.

C. Any dispute You have relating to an event or ticket purchase is between You and Us. In this instance Oztix is the company we have engaged to provide a software platform and related services to facilitate sales of tickets. Oztix are not selling the tickets nor acting as agent or merchant for sales of tickets or the Presenter, and the website oztix.com.au (the "Oztix Website") is owned and operated by Ticket Solutions Pty Ltd (ACN 106 907 206) t/as Oztix ("Oztix") of PO Box 6191 Fairfield Gardens \ QLD, Australia. If You buy tickets from the Oztix Website You are subject to Oztix's Terms and Conditions and may (or not, as the case may be) be subject to these Terms and Conditions as follows;

What You are agreeing to

1. The Presenter nor Oztix are not liable for any claims relating to an event or ticket purchase, except as otherwise set out in these terms and conditions.

2. By visiting, using or purchasing any tickets via this website You agree to be bound by these Terms and Conditions and Our and the Oztix Privacy Policy.("You", "Your").

3. Every ticket sold through this website is also subject to the Presenter's additional event term and conditions (please see above) and any terms and conditions of the venue at which event is held (please see the venue's website) and terms and conditions that may be printed on the ticket.

4. The Presenter reserves the right to add, withdraw, reschedule or substitute artists and/or vary programs, prices, venues, seating arrangements and audience capacity.

5. Use of this website is restricted to personal use and reference only.

Conditions of Sale

6. All Prices quoted are in Australian Dollars and include local taxes (GST).

7. Online sales will cease when the allocation of tickets is sold, at a time otherwise specified or before doors open for the event.

8. The Presenter reserves the right not to sell tickets to any person, agent or company.

9. Tickets will be delivered to You by the method You select during the booking process. If tickets are sent using Registered Post they will only be sent to addresses where the purchaser can sign for delivery. Mail delivery option will cease to be offered 7~10 days before the event.

10. Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser or any subsequent ticket holder.

11. Notwithstanding these terms and conditions, if You use a "disposable" or "temporary" credit card (such as those purchased over the counter at supermarkets) for Your online purchase We are not able to make any refund to You unless a) You can provide full details of the credit card; b) the credit card remains valid; and c) You can produce the online purchase receipt.

12. If You are able to order a ticket before the scheduled on-sale or presale date that was not supposed to have been released for sale, then We will have the right to cancel that ticket (or the order for that ticket) and refund to You the amount that You paid for that ticket. This will apply regardless of whether because of human error or a transactional malfunction of Our website or Oztix's website or other merchant operated systems.

13. If You are able to order a ticket at a price that is different to the advertised price (regardless of the source of that error, and whether it was an error in a price posted on Our website or Oztiix's website or otherwise communicated to You), we will inform You as soon as possible and give You the option of reconfirming Your order at the correct price (and credit or debit Your account as applicable) or cancelling Your order.

14. If we are unable to contact You, You agree that we may treat the order as cancelled. If You choose to cancel after You have already paid the incorrect ticket price for the tickets, You will receive a full refund of the ticket price from us.

15. Note: Your Credit Card statement will itemise a purchase as a charge from "There Is A Free Lunch Pty Ltd."

Refunds and exchanges

16. The Presenter will only refund tickets in accordance with these terms and conditions and to the extent permitted by law. The Presenter or Oztix has no liability to You.

17. We do not replace any lost, stolen or destroyed tickets or exchange or substitute tickets after purchase, except in limited circumstances. We reserve the right to charge You a reasonable fee for the replacement of tickets. Please treat Your tickets like cash, as we cannot replace lost tickets.

18. As Presenter we reserve the right to alter the date, the venue and the entertainment and activities as advertised in its absolute discretion without prior notice to You including the substitution of any artist listed to appear at the event. Your entitlement to a refund in such circumstances is determined by Us as the Presenter and if You do not agree with Our decision, we advise You to please contact Us directly in order to determine Your eligibility for a refund.

19. If the date, time or venue of an event is rescheduled or changed, Your ticket will remain valid for the rescheduled date, time and venue.

20. If We authorise a Refund, We will refund to You the Ticket Price, net of any fees.

21. The Booking Fee, the Handling Fee and the Delivery Fee (if tickets have been delivered) will not be refunded as these services are made to You at time of booking. Delivery fees will be refunded if tickets were not dispatched.

22. Any refund payable can only be made back to the credit card (whether temporary or otherwise) used in the original transaction.

23. We will post any relevant information regarding any cancelled or rescheduled events on our website when applicable. It is Your responsibility to check our website for information in relation to any events.

No Show / Failure to collect tickets / Delivery fulfilment

24. We fulfil Our commitment to You for the sale of tickets by either mailing or by emailing the ticket to You, or by making the ticket available at the door or Box Office for You to collect.

25. If You have elected to receive the tickets by mail or email and have not received Your ticket(s) 72 hours prior hours of the event, please contact Oztix.

VIP Packages

26. We may sell tickets coupled with other offerings such as VIP experiences, music, merchandise etc. (So called "Bundled Sales"). We cannot be held liable or responsible for the non-delivery of any goods or services that have been Bundled with Tickets as we have no oversight over how the fulfilment or delivery of Bundled Sales are managed. It is a condition of sale that all claims about non-delivery of Bundled Sales must be taken up direct with the Us as Presenter. Please contact us for details in this instance.

Pay Over Time Payment Option

27. In some circumstances You may be able to pay for Your ticket over a period of time, in instalments. If both parties agree to this payment option, You agree that We can charge Your credit card a deposit, a booking fee (if any) and then the number of specified instalments, prior to sending You a confirmed ticket.

28. You also agree that paying a deposit means You only have a reservation for a ticket and are not entitled to a ticket to the event until full payment of the instalments and associated fees is made.

29. If Your credit card details change or expire prior to Your payment of any instalment, You agree to contact Us to update Your credit card details.

30. Warning: please ensure You have the financial capacity to complete Your Pay Over Time instalment payments. By not completing all instalment payments, or if You fail to complete after We have notified You, You will forfeit any of Your instalments made. You hereby agree that if, for any reason, We are not able to process any of the instalments on each of the due dates, Your reservation for the ticket will be cancelled and Your deposit, any instalments and any booking fee paid will be forfeited by You.

31. If We cancel Your order for any other reason other than the reasons specified in 30. Above, We agree to repay the instalments (other than the deposit and any booking fee) You have paid to Us, but only to the credit card You specified at the time of selecting the Pay Over Time option, provided that credit card remains valid.

Changes to Terms and Conditions

32. The terms and conditions that apply to any particular transaction will be the published terms and conditions at the time the transaction was finalised. Subject to the preceding sentence, We may alter or change the terms and conditions as they appear on our website from time to time effective immediately from posting on the web site.

33. You should periodically check this page of the web site to ensure that You are aware of the latest terms and conditions.

What happens if You have an inquiry or complaint?

35. For inquiries or complaints regarding the staff and / or amenities at a venue or event, please contact the venue management.

Data Security

37. When We process Your order We collect Your credit card and personal information in accordance with Our and the Oztix Terms and Conditions, Privacy Policy and Privacy Collection Notice.

38. If You are concerned about using Your credit card online please contact us for assistance. info@oztix.com.au.

39. If You deny or dispute a charge on Your credit card made by us, please contact us immediately. We consider credit card fraud to be a serious offence and we aim to fully prosecute each case possible.

40. The images, text, logos and artwork contained within this site are copyright to Presenter, Oztix and/or the relevant licensors. All rights are reserved. Unauthorised use by way of copying, storage, reproduction, publishing electronically or otherwise transmitting in any form or by any means in whole or in part is prohibited. The Oztix logo is a registered trademark.

Disclaimer and Liability

41. You accept that the Internet is not always a reliable and that system outages may occur.

42. Save to the extent set out in the Competition and Consumer Act 2012 (Cth) (including the consumer guarantees under Australian Consumer Law) or otherwise permitted by law, We or Oztix will not be liable for any damages direct, incidental, consequential or otherwise, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from Your purchase of any tickets or Your access to, or use of, or inability to use the web site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not we know of the possibility of such damage.

Choice of Law

43. These Terms and Conditions shall be governed by the laws of the State of Queensland, Australia but legal proceedings may be commenced in any Australian State or Territory.

Australian Consumer Law

44. Our goods and services come with consumer guarantees that cannot be excluded under Australian Consumer Law. Those consumer guarantees apply in addition to any other express warranties which we provide under this Agreement. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
